Senate Passes Housing Package

NAA advocacy led to the inclusion of priority legislation.

On October 9, 2025, the U.S. Senate passed the ROAD to Housing Act as an amendment (S. Amdt. 3901) to the National Defense Authorization Act for FY 2026 (S. 2296). The bill now heads to the U.S. House.

Notably, the ROAD to Housing Act still includes several individual measures that promote the development of rental housing and help to address our nation’s housing supply shortage, including:

  • The Build More Housing Near Transit Act (S. 2363), which would incentivize local governments to build more housing near federally funded transit projects;
  • The Housing Supply Frameworks Act (S. 1299); which would direct HUD to publish guidelines and best practices for State zoning and local zoning frameworks;
  • The inspection provisions from the Choice in Affordable Housing Act of 2025 (S.890); which would streamline burdensome inspection provision and lease-up voucher holders faster;
  • The HOME Investment Partnerships Reauthorization and Improvement Act of 2025 (S. 948) would reauthorize the HOME Investment Partnerships Program, increase the authorized funding level for the program to $5 billion, and make several needed program improvements;
  • Accelerating Home Building Act of 2025 (S. 2361) to overcome local regulatory cost burdens to affordable housing development by encouraging the use of pattern books of pre-reviewed construction designs at the local level; and
  • Housing Affordability Act (S.1527), which increases the per unit loan limits on certain FHA multifamily insured properties.

On July 25, 2025, the U.S. Senate Committee on Banking, Housing and Urban Affairs released its proposed housing legislative package entitled “Renewing Opportunity in the American Dream to Housing Act of 2025”, also known as the ROAD to Housing Act (S. 2651). On July 29, 2025, the Committee favorably passed the legislation unanimously in its markup meeting. 

This bipartisan legislative package clocks in at 325 pages long, with 40 sections, each citing at least one other piece of proposed housing legislation. The National Apartment Association (NAA) joined other industry groups in support of the proposal and has been working over the past week to ensure the proposal’s final language was settled. While not all the ROAD to Housing Act deals exclusively with rental housing, NAA was happy to see the committee include key pieces of priority legislation. 

Included in the committee passed text are sections of the following NAA supported pieces of legislation: 

  • Sec. 203 – Housing Supply Frameworks Act 

  • Sec. 210 – Accelerating Home Building Act 

  • Sec. 211 – Build More Housing Near Transit Act 

  • Sec. 405 – Choice in Affordable Housing Act 

  • Sec. 502 – HOME Investment Partnerships Reauthorization and Improvement Act 

The ROAD to Housing Act contains additional legislative text in a multitude of other housing issue areas, but the bulk of the proposed language works to create even more favorable multifamily housing conditions in the country. 

While passage out of the Committee is just one step in a longer legislative process, it is an important step to highlight, especially for this Congress, the bipartisan agreement that this proposal is starting from. NAA thanks Chairman Tim Scott (R-S.C.) and Ranking Member Elizabeth Warren (D-Mass.) for all their hard work in bringing together so many good housing ideas in a comprehensive and inclusive package. 

What’s Next 

In just a couple days, the U.S. Senate is scheduled to join the House in August recess, allowing for at least a month until the ROAD to Housing can be considered on the Senate Floor.  As conversations continue with Senators on how to further move the ROAD to Housing Act forward, NAA is committed to continued work with our Senate and House champions to ensure that all of our priority issues, both addressed within the ROAD package and not, are given the consideration required by this Congress.
